Description: This panel will revisit the principal tax and related issues that arise when a taxable entity desires to convert to an exempt organization and when an exempt organization desires to become a taxable entity. In the latter category, the panelists will discuss the relatively established law applicable to 501(c)(3) entities. The panelists will also grapple with the IRS’s 20 year old continuing education text in which the IRS stated that exempt organizations cannot voluntarily relinquish tax-exempt status.
