Description: As the 2009-2010 Supreme Court Term gets underway, the UW School of Law will host a half-day discussion of five environmental law cases heard by the court in the 2008-09 Term. Top Northwest environmental lawyers will also discuss the upcoming Term.
In the term that ended June 2009, the U.S. Supreme Court decided five cases involving some of the Nation’s most important environmental laws. Though the questions the Court addressed varied—the standards relating to preliminary injunctions and standing, the use of cost-benefit analyses and jurisdictional authority to permit discharges under the Clean Water Act, and the scope of arranger and joint and several liability under the Comprehensive Environmental Response, Compensation, and Liability Act—the results did not. In each case the Robert’s Court ruled against environmental groups and/or increased liability.
