Description: The Occupational Safety and Health Act (1970) requires employers to furnish employees with a workplace free from recognized hazard that are likely to cause occupational injury, illness, or death. OSHA has a legal right to enter upon an employer’s premises to inspect documents and facilities for compliance with the Act. OSHA schedules periodic inspections of premises and “targets” industries with perceived increased relative risks for occupational injury or illness. OSHA may also conduct inspections of premises and documents in response to an accident, injury, death, or a “whistleblower” complaint. This program defines the legal bases upon which OSHA may instigate an inspection, the prerequisites for entry upon premises for inspection of documents, facilities, equipment, and work processes. This presentation provides recommendations for the establishment of a response team (“Go Team”) to manage the unannounced OSHA inspection, including 2 senior management, on-site management, and legal, medical, safety, industrial hygiene, and ergonomics experts.
