Description:

The Obama Administration has proposed to establish the Federal Reserve Board as a new systemic risk regulator with oversight over newly defined Tier 1 financial holding companies.

Unlike under the current Bank Holding Company Act, coverage of these Tier 1 financial holding companies will not depend on whether they own banks. Designation as a Tier 1 financial holding company would require an examination of the entire corporate structure and divestiture of most non-financial activities. It would also subject these companies to new capital, reporting, and other supervisory requirements. Existing financial holding companies that are designated as Tier 1 financial holding companies potentially will be subject to increased capital and supervisory requirements.
