Description: Virtually every case today involves the discovery of electronically stored information; management of that discovery can be complicated.
The obligations of a lawyer to the Court, a client and an adversary are prescribed by ethics rules and the rules of evidence and civil procedure. Failures in the discovery process can lead to monetary and other sanctions as well as ethical violations. The ABA Model Rules of Professional Conduct, and a growing body of case law, address competence and candor, among other pertinent considerations. The prudent lawyer will understand how emerging trends and the latest cases affect his or her work.
