In recent years as commercial real estate markets expanded, clients became more sophisticated and the market experienced unprecedented demand for hedging instruments to manage interest rate risk on financing packages. In the current environment these hedging instruments can have a material impact on the ability of the client to sell or refinance an asset. Using examples the presentation will focus on points to be aware of at the time at sale/ refinance regarding hedging instruments and how some pre-emptive protection for the lender / hedge issuer can be incorporated into loan /derivative documentation.
