This course proceeds step by step through the process of handling a wrongful termination claim from a plaintiff counsel’s point of view. Topics to be discussed:
• Evaluating claims of potential clients, including introduction, initial interview, investigation, type of adverse employment action, evaluating the client and the client’s situation, evaluating damages
• Evaluating causes of action, including public sector employees, union versus non-union, breach of contract, public policy, discrimination claims, tort claims and federal causes of action
• Actions after evaluation of claims, including rejecting the case, consultation with client, preserving the evidence
• Pre-litigation stage including pre-suit negotiations, exhausting the employer’s internal procedures, administrative agency filings
• First stage of litigation including jurisdiction, venue, drafting the complaint, expert retention
